TERMS AND CONDITIONS ATELIER ELSA & CLAIRE (T&Cs)

Purpose of the T&Cs
These Terms and Conditions (T&Cs) govern the sales of women's creations offered by Atelier Elsa & Claire via the website www.atelierelsaetclaire.com. Any order placed on this site implies full acceptance of these T&Cs, which may be modified at any time. The applicable conditions are those in effect at the time of the order.

ARTICLE 1. OBJECT
The purpose of these T&Cs is to define the conditions of sale for the products offered by Atelier Elsa & Claire on its website. They specify the terms of ordering, payment, delivery, and return management of products. These conditions are accepted unconditionally as soon as the order is validated by the customer.
Atelier Elsa & Claire reserves the right to modify these T&Cs at any time, and the applicable conditions will be those in effect at the time of the order. The products covered by these T&Cs include textile items and accessories for women, babies, children, and adults.

ARTICLE 2. CUSTOMER
The customer must be an adult individual, legally capable, and act as a consumer. To place an order, the customer must fill out a form with mandatory information, such as their name, address, email, and any other data necessary for processing the order.
The information provided by the customer must be accurate, complete, and up-to-date. Atelier Elsa & Claire reserves the right to refuse any order if these conditions are not met, or if the customer does not meet the required criteria.

ARTICLE 3. PRODUCTS
The products offered for sale are described on the Atelier Elsa & Claire website, on each product page. These products are sold subject to availability. The product descriptions are as accurate as possible, but errors or omissions may occur. In such cases, Atelier Elsa & Claire cannot be held responsible.
Product photographs are non-contractual and may not exactly reflect the reality of the items. If the customer has any questions regarding a product, they can contact Atelier Elsa & Claire by email at atelierelsaetclaire@gmail.com.

ARTICLE 4. ORDERING
To place an order, the customer must follow these steps:

  1. Select the desired products and add them to the cart, specifying the quantity and, if necessary, customization options (text, font, patterns, etc.).
  2. Verify the nature and quantity of the products in the cart.
  3. Modify or remove items if necessary.
  4. Finalize the order or continue shopping.
  5. Fill out the order form with the necessary personal information.
  6. Choose the delivery method and payment method.
  7. Verify the order details, including the total price, shipping fees, and accept the T&Cs.
  8. Proceed with payment to confirm the order.
    The order is considered accepted by Atelier Elsa & Claire once the information has been received and validated. Atelier Elsa & Claire reserves the right to refuse, cancel, or terminate an order for legal reasons or if a dispute exists regarding a previous payment.
    If a product is unavailable, Atelier Elsa & Claire will inform the customer within 30 business days and refund the amount for the unavailable products.

ARTICLE 5. PAYMENT
Payment for products is made online by credit card. The order is only validated once the payment is received. Prices displayed on the site are in euros, excluding taxes (VAT exempt according to article 293B of the French General Tax Code). Packaging, processing, and shipping fees are indicated before confirming the order.
Products remain the property of Atelier Elsa & Claire until full payment is made. In the case of delivery outside the European Union, the customer is responsible for paying any customs duties and other taxes applicable in the destination country.

ARTICLE 6. PERSONAL DATA PROTECTION
Atelier Elsa & Claire respects the confidentiality of its customers' personal data. The information collected (name, address, email, etc.) is used solely to process orders and ensure proper follow-up. It is stored securely and is not shared with third parties without your consent.
You have the right to access, modify, delete, or request the transfer of your data by contacting Atelier Elsa & Claire at atelierelsaetclaire@gmail.com.

ARTICLE 7. DELIVERY
Products are delivered to the address provided by the customer when placing the order. The delivery time is estimated when the order is registered, but this time is indicative and may vary. In the event of a delay or delivery issue, Atelier Elsa & Claire cannot be held responsible.
If the delivery address provided by the customer is incorrect or incomplete, the customer will bear the cost of re-shipping. In case of loss or theft of the package, the customer must contact the carrier directly to file a claim.

ARTICLE 8. FORCE MAJEURE
Atelier Elsa & Claire cannot be held responsible for any delay or failure in fulfilling its obligations due to force majeure, as defined by applicable law. This includes unforeseeable and irresistible events beyond the control of Atelier Elsa & Claire.

ARTICLE 9. WITHDRAWAL AND ORDER CANCELLATION

  • Exchanges can be requested within 14 days of receiving the product.
  • The product must be unused, in its original condition, and returned in the original packaging with all accessories.
  • Return shipping costs are the customer’s responsibility unless the exchange is due to a defect or an error on our part.
  • The customer can cancel the order at any time before shipping and receive a full refund.
  • If the order has already been shipped, the customer must wait to receive the product and follow the return process to obtain a refund.

ARTICLE 10. AFTER-SALES SERVICE
If there is a problem with a product, the customer must send an email to atelierelsaetclaire@gmail.com with photos to demonstrate the issue. If a return is necessary, the customer must request it within 14 days of delivery. Return shipping costs are the responsibility of the customer, unless the product is defective or non-conforming. Claims made after this period will not be accepted.

ARTICLE 11. MODIFICATIONS TO THE T&Cs
Atelier Elsa & Claire reserves the right to modify its Terms and Conditions at any time. Significant changes will be communicated to the customer by email or during their next order. It is advisable to regularly check the T&Cs for any updates.

ARTICLE 12. INTELLECTUAL PROPERTY
All products, images, photographs, texts, and other elements on the site are protected by intellectual property rights. The customer agrees not to reproduce, use, or exploit these elements without prior authorization from Atelier Elsa & Claire. Any unauthorized reproduction may lead to legal action for infringement.

ARTICLE 13. COOKIES
The site uses cookies to analyze traffic and improve the user experience. The customer can refuse the use of cookies by configuring their browser.
